Abstract

The Law No. 319 dated December 22, 2023 constitutes a historic station in the process of developing social security legislation in Lebanon. This law - published in the Official Gazette No. 53 on 28/12/2023 - amended some provisions of the Social Security Law and established the retirement and social protection system in the National Social Security Fund. The adoption of this legislation was the result of efforts that lasted about twenty years of studies and consultations on the reform of the end-of-service system, where the adoption of a pension system was repeatedly postponed despite the urgent need for it. The issuance of the law coincided with difficult economic conditions that highlighted the inadequacies of the previous regime; as end-of-service indemnities lost their value significantly as a result of the collapse of the exchange rate and inflation.

الملخص (Abstract in Arabic)

يشكل القانون رقم 319 تاريخ 22 كانون الأول/ديسمبر 2023 محطة تاريخية في مسار تطوير تشريعات الضمان الاجتماعي في لبنان. فهذا القانون -المنشور في الجريدة الرسمية العدد 53 بتاريخ 28/12/2023 -عدّل بعض أحكام قانون الضمان الاجتماعي وأنشأ نظام التقاعد والحماية الاجتماعية في الصندوق الوطني للضمان الاجتماعي. جاء إقرار هذا التشريع ثمرةً لجهود استمرت نحو عشرين عامًا من الدراسات والمشاورات حول إصلاح نظام نهاية الخدمة حيث تأجّل اعتماد نظام معاش تقاعدي مرارًا رغم الحاجة الماسّة إليه. وقد تزامن صدور القانون مع ظروف اقتصادية صعبة أبرزت قصور النظام السابق؛ إذ فقدت تعويضات نهاية الخدمة قيمتها بشكل كبير نتيجة انهيار سعر الصرف والتضخم الجامح.
