Abstract

From oral agreement to paper to digital format, the contract, which encapsulates and defines the relationships between those who compose it, has undergone multiple revolutions. These days, it's the smart contracts that are interfering between technology and law. A new generation of contracts known as intelligent contracts (smart contracts) has emerged as a result of the remarkable advancements in artificial intelligence coupled with the development of blockchain technology and crypto money. Furthermore, this intelligent contractual model is no longer limited to the creation of traditional agreements alone. Because it can be created and executed automatically, often without external intervention, it tends to expand to other types of legal acts and a wide range of electronic transactions.

French Abstract

L'accord oral au papier en passant par le format numérique, le contrat, qui encapsule et définit les relations entre ceux qui le composent, a subi de multiples révolutions. De nos jours, ce sont les contrats intelligents qui interfèrent entre la technologie et le droit. Une nouvelle génération de contrats, connus sous le nom de contrats intelligents (smart contracts), a émergé grâce aux avancées remarquables de l'intelligence artificielle couplées au développement de la technologie blockchain et des cryptomonnaies. De plus, ce modèle contractuel intelligent ne se limite plus à la création d'accords traditionnels. Parce qu'il peut être créé et exécuté automatiquement, souvent sans intervention externe, il tend à s'étendre à d'autres types d'actes juridiques et à un large éventail de transactions électroniques.

الملخص (Abstract in Arabic)

من الاتفاقات الشفهية إلى العقود الورقية ثم إلى الصيغ الرقمية، شهد العقد—بوصفه الأداة القانونية التي تُنظّم وتُحدّد العلاقات بين أطرافه—تحوّلات جوهرية ومتعددة عبر العصور. وفي الوقت الراهن، باتت العقود الذكية تُشكّل حلقة وصل جديدة بين القانون والتكنولوجيا.

لقد أفرز التقدّم الملحوظ في تقنيات الذكاء الاصطناعي، مقرونًا بتطورات تكنولوجيا البلوكشين والعملات المشفرة، جيلًا جديدًا من العقود يُعرف بـ"العقود الذكية". ويُلاحظ أن هذا النموذج التعاقدي المعاصر لم يعد محصورًا في نطاق إبرام الاتفاقيات التقليدية فحسب، بل يمتد ليشمل أشكالًا أخرى من التصرفات القانونية والمعاملات الإلكترونية المتنوعة، وذلك بالنظر إلى قدرته على الإنشاء والتنفيذ الآلي غالبًا دون الحاجة إلى تدخل بشري مباشر، مما يُضفي عليه طابعًا ذاتيًا واستقلاليًا في الأداء القانوني
