Abstract

The crime of smuggling migrants is one of the biggest challenges facing criminal justice agencies in the modern era due to its seriousness that is sweeping the global arena, The International charters and national laws included strict provisions criminalizing the smuggling of migrants. Perhaps one of the most important international achievements in the history of the struggle to curb this crime is the United Nations Convention against Organized Crime across the border and the three protocols attached to it. Among them is the 2000 Protocol on Combating the Smuggling of Migrants by Land, Sea and Air, which urged the United Nations and member states to cooperate and exchange information, And the adoption of an internal legal system that provides for combating this transnational crime with Non-National dimensions, which threatens human safety and threatens the security of states.

الملخص (Abstract in Arabic)

تُعدّ جريمة تهريب المهاجرين من أكبر التحديات التي تواجهها أجهزة العدالة الجنائية في العصر الحديث نظراً لخطورتها التي تجتاح الساحة العالمية، فلقد تضمنت المواثيق الدولية والقوانين الوطنية أحكام صارمة تجرم فيها تهريب المهاجرين، ولعل من أهم الإنجازات الدولية في تاريخ الكفاح للحد من هذه الجريمة اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الحدود والبروتكولات الثلاثة المرفقة بها، ومنها البروتوكول المتعلق بمكافحة تهريب المهاجرين عن طريق البر والبحر والجو لعام 2000، والذي حثَّ منظمة الأمم المتحدة، والدول الأعضاء على ضرورة التعاون وتبادل المعلومات، واعتماد نظام قانوني داخلي ينص على مكافحة هذه الجريمة ذات البعد عبر الوطني، والتي تهدد سلامة الإنسان وتمس بأمن الدول
