Abstract

Laws are not only made by acts of legislature but also the judicial authority participates in this process. The latter is the “living law” or “ effective law”. This leads us to enlighten on the recent decisions of the Egyptian Courts in order to reveal the principles applied by them, the problematics that had occurred from its application and therefore to discuss and give our comment relating to these matters. This decisions evolve around the subjects of arbitration, Power in proof of the electronic documents, Ad hoc arbitration, Testimony, compensation in case of the renunciation of the contract and the right of the administration to recourse to its employees to take back the paid compensation

الملخص (Abstract in Arabic)

القانون لا تصنعه النصوص فقط بل يشارك القضاء أيضاً في صنعه. فالقضاء هو " القانون الحي" أو "القانون في حالة الحركة". إدراكاً لهذه الحقيقة كانت هذه الإضاءات، التي نتناول من خلالها بعض الأحكام الحديثة الصادرة عن القضاء المصري، نعرض من خلالها للمبادئ التي تضمنتها هذه الأحكام وما تثيره من تساؤلات ومناقشتها، وملاحظاتنا بشأنها وتعليقاتنا عليها. تتضمن هذه الأحكام مسائل متنوعة في التحكيم، حجية الرسائل الالكترونية، اليمين المتممة ، اليمين الحاسمة، التعويض عن العدول عن إبرام العقد، ورجوع جهة الإدارة على تابعها بما أدته عنه من تعويض
