قاعدة المعروف عرفاً كالمشروط شرطاً

Abstract

Custom (commonly known) has a place in Sharia and law. The rule under study can include many texts of the law in its various branches. To study this important rule, several questions have been asked about it: Is this rule true, what is its concept, what are its limits, what is it withheld and what are its applications? And if what people are familiar with is not accepted by Sharia or not implied by law, goes under this rule? Can what people are familiar with be considered a custom and in this way can be applied by the law? What is the correct judgment here? Therefore, we divided this study into two main branches: The first branch: the concept of a rule known as "Commonly known is equal to the conditional,"The second branch: The pretext of the rule known, as commonly known is the same as the conditional and its applications. I concluded that there are many practical applications of this rule before the courts, whether in personal status law, commercial law, maritime trade law, or civil law, in addition to the existence of these applications in international trade law, which confirms the importance of this rule and the scope of its scope of application in various branches of law.

الملخص (Abstract in Arabic)

للعرف مكانة في الشريعة والقانون، والقاعدة محل الدراسة، يمكن أن يندرج تحتها العديد من نصوص القانون بمختلف فروعه، ولدراسة هذه القاعدة الهامة تم طرح عدة أسئلة حولها، هل هذه القاعدة صحيحة وما مفهومها وما حدودها، وما حجبتها وما هي تطبيقاتها؟ وهل إذا كان ما تعارف عليه الناس لا يقبله الشرع، أو لا ينص عليه القانون، يدخل تحت هذه القاعدة، وهل كل ما تعارف عليه الناس، يمكن اعتباره عرفاً، وبالتالي يمكن تطبيقه، أم ما هو الحكم؟؟؟. لذلك قسمنا هذه الدراسة إلى فرعين رئيسيين: الأول عن مفهوم قاعدة المعروف عرفاً كالمشروط شرطا ًو الفرع الثاني عن حجية قاعدة المعروف عرفاً والمشروط شرطاً وتطبيقاتها وانتهيت إلى أنه يوجد العديد من التطبيقات العملية لهذه القاعدة أمام المحاكم، سواء في قانون الأحوال الشخصية أو القانون التجاري أو قانون التجارة البحرية، أو القانون المدني، إضافة لوجود هذه التطبيقات في القانون التجاري الدولي، وهو ما يؤكد على أهمية هذه القاعدة وسعة نطاق إعمالها في مختلف فروع القانون.وتعتبر هذه القواعد الفقهية من النصوص العامة والشاملة لجميع أفراد المجتمع، على اختلاف مذاهبهم وبيئاتهم وأعرافهم وألوانهم.
