التعويض العقابي في النظام القانوني اللبناني-عندما يذوب الثلج

Abstract

The conception of compensation in the Lebanese legal system is based on equalizing between the compensation value and the amount of damage, and mainly this conception is independent of the notion of mistake and its aggravation. This Article 134 of the Lebanese Code of Obligations and Contracts stated expressly the latter idea and took into consideration the moral damages not only the materials ones. This conception of compensation adopted in Civil law legal systems differs radically and clearly from the idea of compensation in the Anglo-Saxon laws. Punitive compensation is related to the act committed and its consequences. So, the punitive compensation is not a compensation for damage but a punishment for misconduct.

الملخص (Abstract in Arabic)

إن طبيعة التعويض في النظام القانوني اللبناني ترتكز على فكرة التعادل بين قيمة التعويض ومقدار الضرر، ويتم ترتيبه بمعزل عن الخطأ وجسامته، هذه القاعدة العامة التي تبناها المشترع قانون الموجبات والعقود اللبناني، شأنه شأن القوانين في منظومة القانون المدني فيما يخص التعويض. ولم يأخذ المشرع فقط بالضرر المادي بل أيضا" شمل الضرر المعنوي وهذا ما أكدته المادة 134 من قانون الموجبات والعقود. وفي المقابل، ان طبيعة التعويض في النظام القانوني الأنكلوأميركي ترتكز على قاعدة أساسيةوهي عدم الارتباط بين التعويض ومقداره وفكرة الضرر ومقداره. فمؤسسة التعويض كمقابل للضرر (المبدأ) بالمقارنة مع فكرة التعويض في القوانين ذات النزعة الأنكلوساسكونية تختلفان جذرياً وبكل وضوح. وبالتالي ان التعويض العقابي، هو تعويض يرتبط بالمفهوم الذي تقوم عليه هذه المؤسسة في القانون الأنكلواميركي وعلى وجه الخصوصلا يعتبر انه تعويض عن ضرر وإنما عقوبة لسوء التصرف.
