Abstract

It seems that trafficking in persons is a universal phenomenon, which spare no State. Tunisia is affected by this degrading crime as a country of origin, destination and transit. It is doing significant efforts in order to combat this appalling offense that reduces its victim to goods sold and bought for a miserable price. This study focuses on the efficiency of the victim’s protection which is a certain one, since it immunes the trafficked person from prosecution and provides her/him with different assistances, but it remains limited, as long as the trafficking actors can’t afford its implementation and the State doesn’t care about the vulnerability factors.

French Abstract

Infraction dégradante, la traite des personnes ne semble épargner aucun Etat, y compris la Tunisie qui en est touchée en tant que pays source, de destination et de transit fournissant des efforts significatifs en vue de combattre ce crime odieux réduisant sa victime en une marchandise qui se vend et s'achète à vil prix et appelant ainsi sa protection. La présente réflexion se focalise sur l'efficacité d'une telle protection qui bien que certaine, car permettant de mettre la victime à l'abri des poursuites et se traduisant par des mesures variées, reste insuffisante tant que les acteurs de la traite ne sont pas bien outillés pour sa mise en œuvre et que l'Etat ne s'attaque pas comme il se doit aux facteurs de vulnérabilité.

الملخص (Abstract in Arabic)

يبدو الاتجار بالأشخاص ظاهرة عالمية تمتد الى كل الدول ومنها تونس التي تعتبر بلد منشأ ومقصد وعبور بصدد بذل مجهودات معتبرة في مكافحة هذه الجريمة النكراء التي تحول ضحيتها الى سلعة تباع وتشترى بثمن بخس، مما يستوجب حمايتها. وتنصب هذه الدراسة على نجاعة حماية الضحية، وهي نجاعة مؤكدة لأنها تحمي من التبعات العدلية وتوفر مساعدات مختلفة، لكنها تبقى محدودة طالما لم تزود الأطراف المتدخلة فيها باليات تطبيقها ومادامت الدولة لا تهتم بعوامل الاستضعاف.
