قانون المعاملات الالكترونية وأثره على القواعد التقليدية في مرحلة ابرام العقد وتنفيذه

Abstract

With the enactment of the new e-transaction and data protection law issued on 10 October 2018, electronic contracts were acknowledged. The new law has brought some improvements to the legislative framework that are certainly going to help the development of the electronic commerce. In this paper, we will try to identify and clarify this new law particularly concerning the execution of the e-contract.

الملخص (Abstract in Arabic)

مع صدور قانون المعاملات الإلكترونية رقم ٨١/٢٠١٨ أصبحنا امام تحول تشريعي يواكب التطور التقني ويعترف بالتعاقد عن بعد. وازاء هذه التحولات التشريعية التي اقرها هذا القانون، كان لا بد من دراسة أثرها على القواعد التقليدية المكرسة في قانون الموجباتوالعقود و قانون اصول المحاكمات المدنية و قانون حماية المستهلك.و نظرا لتشعب هذه التحولات على الصعيد التشريعي فسيقتصر هذا البحث على تبيان اثر قانون المعاملات الإلكترونية رقم ٨١/٢٠١٨ على القواعد التقليدية لمرحلة ابرام العقد و تنفيذه.
