الأحوال الشخصية بين قدسية النص ومشروعية الاجتهاد

Abstract

Personal status rules are directly related to human life and have legal effects on social life in general. Those rules are developed conditionally and carefully by the jurisprudence, thus the judge cannot harm its sanctity or deviate from its purposes or neglect to thinking deeply about its implications. Therefore, the judge is given discretionary power regarding the non-textual issues that are subject to customs and change of interests in a way that guarantees family stability and community safety within the legitimacy of jurisprudence whether the text is explicit or the rule is implied.

الملخص (Abstract in Arabic)

الأحوال الشخصية و ثيقة الصلة بحياة الانسان، رتب عليها القانون اثرا" قانونيا" في حياته الاجتماعية و هي تدور بين منصوص عليه و بين ما هو دائر في فلك الاجتهاد بشرطه المقاصدي، و القول بالخروج المطلق عن النصوص مس بقدسيتها، و تنحية لمنهجيتها، و تعطيل للوعي عن التدبر المطلوب فيها، و ابعاد للعقل عن التفكير العميق في مدلولاتها. لذا اعطى القاضي سلطة تقديرية فيما لا نص فيه من المسائل التي تخضع للأعراف وتغير المصالح بما يضمن استقرار الاسرة وأمان المجتمع ضمن مشروعية الاجتهاد في اعمال النص وفيما لا نص فيه.
